RCRA、CERCLA/SARA Translation and Infrastructure Studies Project.

Soil pollution has been a great issue and problem in Taiwan, while the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), commonly known as Superfund, was enacted since December 11, 1980. This law created a tax on the chemical and petroleum industries and provided broad Federal authority to respond directly to releases or threatened releases of hazardous substances that may endanger public health or the environment. Over five years, $1.6 billion was collected and the tax went to a trust fund for cleaning up abandoned or uncontrolled hazardous waste sites. This project would like to learn from USA’s twenty years of experiences and adopt the best practices to help clean up our environment and precious land. This study involves translation of RCRA, CERCLA/SARA into Chinese as well as infrastructure studies on legal part for general public and private interests to have access to USA’s valuable experiences and help future improvement in Taiwan’s Soil and Groundwater Pollution Remediation Act. This report also provides some guidelines for PRP search as well as Cost Recovery Strategy from US experiences, LUFT manuals are also abstracted for reviewers to explore. Comparisons between U.S. and Taiwan legal system differences are analyzed and some recommendations are also suggested by the study team to help improve Taiwan’s Soil and Groundwater Pollution Remediation Act to obtain a more justified and fair result.
